Shipping & Delivery Policy — B2B

1. B2B Scope
This Shipping & Delivery Policy applies exclusively to business customers ordering through https://privatelabelsmellingsalt.com or under an accepted B2B quotation.
2. EU and Worldwide B2B Shipping
We ship B2B orders within Germany, throughout the European Union and to eligible destinations worldwide. Shipping is available only where the specific product, quantity, packaging and destination can be served legally and technically.
Availability may depend on product and transport classification, carrier acceptance, packaging requirements, customs/import requirements, sanctions or trade restrictions, destination-country product rules and local registration or labelling requirements. We therefore do not guarantee delivery to every country or territory.
3. Sample Sets
Where a Sample Set is expressly advertised as shipping included, standard shipping is included in the displayed Sample Set price for eligible and serviceable destinations within Germany, the EU and worldwide.
Shipping included does not include customs duties, import VAT, customs brokerage or clearance fees, local taxes, storage fees, government charges or destination-specific regulatory costs. These costs are borne by the business customer unless expressly agreed otherwise.
If shipment to a destination requires an exceptional regulated transport service or surcharge not covered by the advertised shipping-inclusive offer, we may contact the customer before accepting the order to agree different conditions.
If shipment cannot legally or technically be provided, we may reject the order before acceptance and refund any payment already received.
4. Private-Label Production Orders
Shipping costs for private-label production orders are not included in the unit price unless expressly stated otherwise in the quotation.
Shipping method, shipping costs and transport conditions are determined individually according to order quantity, shipment weight and dimensions, destination, product classification, carrier requirements, packaging requirements, customs requirements and requested transport method. The applicable shipping terms are stated in the quotation or order confirmation.
5. Delivery and Production Times
No universal delivery time applies to all orders. Delivery and production times may vary depending on order quantity, production status, product configuration, artwork/label approval, availability of packaging or components, destination, transport method, regulatory requirements, carrier availability and customs clearance.
For Sample Sets, the expected dispatch and/or delivery period is communicated when the order is accepted or in the corresponding order confirmation. For private-label manufacturing orders, the expected production and dispatch/delivery period is stated in the individual quotation or order confirmation. Unless expressly agreed as binding, stated delivery and transit dates are estimates.
6. EU Shipments and VAT
VAT treatment depends on customer status, destination, valid VAT identification and applicable law. For eligible supplies of goods to VAT-registered businesses in another EU Member State, specific intra-EU VAT treatment may apply if the statutory requirements are satisfied. A valid VAT identification number and legally required evidence may be required. The VAT treatment stated in the checkout, order confirmation or final invoice applies subject to applicable law.
7. Shipments Outside the European Union
Shipments outside the European Union may be subject to customs clearance, import duties, import VAT, local taxes, import permits, product-registration requirements and destination-market obligations. Unless expressly agreed otherwise, these obligations and costs are the responsibility of the recipient.
The customer is responsible for providing all company, customs, tax and import information required for shipment and clearance.
8. Import and Destination-Market Responsibility
The customer must inform us of the intended destination country before production approval where destination-specific requirements may apply. Product composition, packaging, label language, warning information, product registration and regulatory obligations may differ between markets. Acceptance of an order does not constitute a general representation that a product may be marketed in every country unless expressly confirmed for the relevant project.
9. Transfer of Risk
Where goods are shipped at the business customer's request and the statutory requirements of section 447 German Civil Code (BGB) apply, risk passes in accordance with the applicable statutory provisions when the goods are handed over to the carrier, freight forwarder or other person designated to perform shipment.
Different delivery or risk-transfer terms may be agreed in the individual quotation or order confirmation. Where Incoterms are expressly agreed, the Incoterm stated in the quotation/order confirmation applies to the relevant shipment.
10. Transport Restrictions
Some products may be subject to special carrier, packaging, documentation or transport requirements. If a carrier refuses a shipment or a shipment becomes legally or technically impossible, we may select another suitable transport method, propose amended shipping conditions, reject an order before acceptance or address an accepted order in accordance with the contract and applicable law if performance becomes impossible.
Material additional costs or changes will be communicated before implementation where reasonably possible.
11. Failed Delivery and Incorrect Address
The customer is responsible for providing a complete and correct delivery address and all required customs/company information. Additional costs caused by incorrect addresses, refused acceptance, missing import documents, unsuccessful customs clearance attributable to the customer or repeated delivery attempts may be charged where legally permissible.
